January 2024 HR Compliance Dates and Deadlines

January 31

  • Quarterly Form 720 for goods and services subject to excise tax.
  • Annual Form 940 regarding annual Federal Unemployment Tax Act (FUTA) reports is due if quarterly FUTA taxes weren’t paid when due.
  • Quarterly Form 941 for income tax, Social Security, and Medicare withholdings from employee paychecks.
  • Form 943 regarding agricultural employers.
  • Form 945 regarding Annual Return of Withheld Federal Income Tax for non-payroll payments for the previous year.
  • Forms 1095-B and 1095-C for reporting health insurance coverage should go to employees.
  • W-2s, W-3s and 1099-MISC forms must go to employees, freelancers, and contractors. This is also the due date for this form with only boxes 8 and 10 checked to be sent to the recipient.
  • Form 1099-NEC regarding non-employee compensation is due to both the IRS and the recipients.

February 2024 HR Dates and Deadlines

February 1

  • OSHA Form 300A regarding reportable injuries and illnesses in the workplace should be posted.

February 10

  • Annual Form 940 is due if quarterly FUTA taxes were paid when they were due.

February 28

  • Deadline to file ACA Forms 1094-C, 1095-C, 1099-MISC without NEC to the IRS if you are paper filing.
  • Form 8809 paper filing deadline.
  • Creditable Coverage Disclosure to CMS, for calendar year plans.

March 20204 HR Dates and Deadlines

March 1

  • HIPAA Breach Notification must be filed if you are a HIPAA-covered entity.
  • Form M-1 regarding multiple employer welfare arrangements (MEWA) and any entity claiming exceptions (ECE).

March 2

  • OSHA Form 300A if you are filing electronically.

March 15

  • Form 8809 electronic filing deadline.
  • S Corp (Form 1120-S) and Partnership (Form 1065) Tax Returns regarding profits, losses, dividends, and credits in S Corporations or business partnerships.
  • Form 2553 regarding qualification as an S Corporation.

March 31

  • Form 1099-MISC if reporting NEC in box 7.
  • Form 1099 if you are filing electronically.
  • EEO-1 reporting and filing deadline.

April 2024 HR Dates and Deadlines

April 1

  • Form 1094-C, 1095-C, 1099-MISC without NEC deadline for filing electronically.

April 15

  • Tax Day filing deadline for C Corporations and personal tax returns.
  • Form 7004 regarding a request for an automatic six-month extension to file certain tax information and returns.
  • Form 8928 regarding self-report COBRA administration compliance failures.

April 28

  • Summary Plan Description (SPD) regarding documentation for employees in retirement plans or health benefit plans covered by ERISA.

April 30

  • Quarterly Form 720
  • Quarterly Form 941

May 2024 HR Dates and Deadlines

May 15

  • Form 990 and other non-profit tax returns.

June 2024 HR Dates and Deadlines

  • No deadlines in June!

July 2024 HR Dates and Deadlines

July 31

  • Quarterly Form 720
  • Quarterly Form 941
  • Form 5500 regarding information about 401(k) plans.
  • Form 5558 regarding requests for an extension of 2.5 months for filing employee plan returns.
  • Patient-Centered Outcomes Research Institute (PCORI) Fee to remain in compliance with Affordable Care Act regulations.
  • Perform a compliance check to ensure you have done everything necessary in the past six months.

August 2024 HR Dates and Deadlines

  • No deadlines in August!

September 2024 HR Dates and Deadlines

  • Summary Annual Report (SAR) regarding the information that appears in an ERISA plan’s Form 5500.

October 2024 HR Dates and Deadlines

October 3

  • Qualified Small Employer Health Reimbursement Arrangement (QSEHRA) regarding plans that began January 1, 2024.
  • Retiree Drug Subsidy (RDS) Application due to CMS.

October 15

  • Medicare Part D Notice of Creditable Coverage should be delivered to plan participants.

October 31

  • Quarterly Form 720
  • Quarterly Form 941

November 2024 HR Dates and Deadlines

November 1

  • Remind employees to submit FSA receipts before the end of the year!

December 2024 HR Compliance Dates and Deadlines

December 29

  • Nondiscrimination testing regarding 401(k) plans, 125 Premium Only Plans (POP), and flexible spending accounts (FSA).
  • Employee handbook review
